What is Law 25?

Law 25 (adopted in 2021 as Bill 64) modernized Québec's Act respecting the protection of personal information in the private sector. It gives businesses concrete obligations: designate a privacy officer, keep an incident register, publish a privacy policy, frame consent and assess projects that involve personal information.Commission d'accès à l'information — Main changes brought by Law 25

Does Law 25 apply to my small business?

Yes, as soon as you collect, hold, use or communicate personal information in Québec: names, emails, phone numbers, customer or employee data. The law sets no size threshold. A two-person company has the same obligations in principle as a large one, scaled to the sensitivity of the information and its means.CAI — Scope of the Act (businesses)

Who must be the person in charge of the protection of personal information?

By default, the person with the highest authority in the business, often the president or the CEO. The function can be delegated in writing to someone else. The officer's title and contact details must be published, notably on the website, so that anyone can exercise their rights of access or rectification.CAI — Person in charge of the protection of personal information

Security audit or penetration test: which one first?

The audit if you have never taken stock: it covers the organization, processes, access, backups and compliance, not only the technology. The penetration test if you expose a critical application or service on the Internet and want to know whether it holds. The two complement each other; the audit says what to prioritize, the test verifies.

Can an audit cover Law 25 at the same time?

Yes. A compliance audit checks the designated officer, the incident register, the privacy policy, consent, privacy impact assessments and the security measures that protect personal information. The same controls also serve ISO 27001 or SOC 2. The deliverable is a documented gap and an action plan, not a certificate.
